Earth Day is Celebrated by More Than 190 Countries

Have you planted a tree today? It is Earth Day, a day to celebrate our planet and encourage improvement of the environment. When you think about it though Earth Day should be every day. We inhabit this planet and pollute it through our own means on a daily basis and in return the Earth provides us with oxygen, water, and LIFE! The Earth is ever generous and nurturing and we need to return the love.

Earth day marks what many consider to be the anniversary of the environmental movement dating back to 1970. At the time air pollution was seen as prosperity. The world was oblivious to environmental concerns. This was a time of war and protest, hippies and flower power, Simon & Garfunkel. Gaylord Nelson, a U.S. Senator from Wisconsin was inspired by student protests of war when he realized that people could channel that kind of energy into the idea of environmental protection.

It did not matter if you were rich or poor, democrat or republican Earth Day brought people together to support a sustainable environment. Now more than a billion people in more than 190 countries celebrate it globally. Anyone can participate whether it is by online activism, local campaigns, or grand fundraising events. You don’t just have to participate for one day. Maybe you can plant a tree tomorrow. Or maybe you can start carpooling to work. Any small step to help the planet is way to be thankful.

There is saying ‘if you can read this, thank a teacher.’ Well, if you are breathing, thank the Earth.

Aereo Vs. the Broadcast Network Industry — The Supreme Court Case that will Change TV Forever.

Tomorrow, the US Supreme Court will hear possibly the single most important case of the technological age.  This case will likely change television, and the way Americans watch TV, forever.

Disney (parent company of ABC), Comcast (parent of NBC), 21st Century Fox (parent of FOX Television Network), and CBS (owner of CBS Television Network and co-owner of The CW) are all suing Aereo, Inc. for copyright infringement.

But before we get into all the legal mumbo jumbo, let’s start with the basics.

Aereo is an online tv streaming service that spent nearly two years on research and development of a new, simplified way to legally provide customers with live, free over-the-air (OTA) broadcasts and a DVR solution without having to pay $70+ a month for a cable service.  They figured out a way to take the old rabbit-ear antenna technology, shrink it down to about the size of a dime, and install them in mass quantities around the country.  Each antenna is connected to it’s own, individual DVR, and that DVR is streamed online to the customer through Aereo.  In this situation, Aereo is simply renting out equipment to the customer and handling the upkeep of that equipment.  The customer must live in the same broadcast market in which the Aereo antenna is installed (for example, a customer in Orlando could not rent an Aereo antenna from New York , it must be in Orlando).  In essence, Aereo is nothing but a really long cord, no different than if you lived in an apartment, installed an antenna just off of apartment property and ran a cord from the antenna to your apartment yourself, only Aereo is handling the upkeep of that antenna and cable.

At least, that’s Aereo’s defense.

The broadcasters disagree, claiming copyright infringement on grounds of public performance. What does that mean?

Under US copyright law, you do not have to pay royalty/license fees to a copyright holder as long as you’ve legally obtained the copyrighted material and are using it for personal use only, or ‘private performance’.  This is why we can watch OTA TV in our living rooms right now, we’ve obtained the material legally over the airwaves, and are privately watching that content.  However, if you were to invite the whole neighborhood to your house to watch tv and charged a fee to get in, that’s a ‘public performance’, which is in violation of copyright law.

The broadcasters are claiming that Aereo is a public performance because they are obtaining the OTA broadcast themselves, which is legal, but offering it to others at a charge.

Now the US Supreme Court must decide whether simply charging customers makes this a public performance, or if it’s simply a rental charge and service fee, which could be argued is simply an alternative to buying rabbit-ears from your local electronics store and fixing them yourself if they break.

The ramifications of this ruling, either way it goes, cannot be understated.  If the broadcasters win, Aereo, and it’s entire business model, are completely out of options and must shut down, leaving customers with fewer options and the broadcasting industry keeps the status quo.  A status quo that is increasingly being challenged by the age of the internet and on demand content.  A status quo that will eventually need to be rethought.

On the other hand, if Aereo wins, it could mean an entirely new way to watch TV and a huge paradigm shift in the entire television industry.  Not only could this open up a whole new market of services like Aereo, but cable/satellite TV operators like Bright House, Time Warner, DirecTV, Dish, and many others could set up similar systems and offer local channels themselves.

And that is exactly what broadcasters don’t want.  With the current model, for those cable and satellite providers to offer local channels, the cable and satellite providers (in most cases) have to pay the local affiliates for the right to rebroadcast their signal, and the broadcast networks get a cut of that money.  If cable providers begin picking up the signal free OTA, that means less revenue for local affiliates, and in turn less for the networks.

This is why the major networks, including CBS, FOX, ABC, and NBC, have all said if Aereo wins, they will pull all of their popular programming from their broadcast networks and go exclusively cable-only, leaving their local affiliates with nothing but ‘public service’ and ‘educational and informational’ programming that is required by law.

However, more likely than not, backlash from customers will force broadcasters to rethink that decision, or at least offer the popular content via the internet easier and faster (as opposed to behind paywalls, verification logins, or an 8-day broadcast delay that most networks use currently).  Eventually, the broadcasters will be forced to rethink their current model one way or another in this situation.

No matter which way the Supreme Court rules, the decision will undoubtedly cause major changes to the way Americans watch TV.  Whether that change comes sooner or later, that’s the major question.

NY Jets Hope to Improve Through Free Agency

Teams in the National Football League normally use the offseason to make necessary adjustments to their roster and staff in order to set achievable goals. Typically, when a team struggles is because the strategy put in place by the coach is not bringing the best out of the roster available. On other occasions, the team may fail, simply because the talent available isn’t good enough to compete at the elite levels of the league. The New York Jets have been struggling with both phases of the franchise since they last played in the American Football Conference (AFC) championship three seasons ago.

When a team fails to develop drafted players, they use free agency in order to improve at key positions. Free agency is a period of time during the NFL off- season in which unemployed players and players with expiring contracts hit the market. During this period, players can choose which team’s contract they want to accept. Every off-season, there seems to always be a great talent to be bought. This year, the Jets landed signings with running back (RB) Chris Johnson and Quarterback (QB) Michael Vick. Both have been key areas of need for the Jets for some time now. Jets have failed to find a proper “feature back” to be the anchor of their time-consuming offense. They have also been missing a field general that doesn’t turn the ball over.  Vick and Johnson mean a serious upgrade for the Jets with their experience and athleticism.

Quentin Tarantino Resurrects Leaked Film Script

In January, filmmaker Quentin Tarantino shut down production on a film he was working on because the script was leaked by gossip website, The Gawker. This was very sad news for Tarantino fans everywhere. He sued the website for leaking confidential information and now has decided to bring back the script. Last night in Los Angeles, Tarantino along with Sam Jackson, Kurt Russell and several other highly acclaimed actors took the stage in a reading of the original script. This was prefaced with Tarantino explaining that it is only the first draft and will be worked on a lot more, stating that the fifth chapter would be completely rewritten among other things. With tickets available for $200, a lucky 1200 people were able to witness a once in a lifetime event.

The reading of the script was narrated by Tarantino with the actors simply reading their lines. Although a graphic and gory plot (did we really expect anything else from him?) no props were involved and guns were portrayed with hand gestures and “Bang” sounds. With only 3 days of rehearsal time, the cast was surprisingly collected and cohesive, although Tarantino would call for re-do’s if anyone strayed from the script or was lost in the roaring applause. The hope is for the script to be rewritten and brought to life on the silver screen in the next couple of years. Casting will resume from where it had left off although judging by the reading, it seems as if Tarantino has made up his mind. Described as the next “Reservoir Dogs,” this movie already has a great amount of hype and is sure to be the next great hit.

Hidden in the wheel of a plane, a boy survives a 5 and a half hour flight

This Sunday as a plane landed in Maui, Hawaii coming from San Jose, California, a 15-year old boy walked out on to Hawaiian Airlines landing field after apparently hiding behind one of the plane’s wheels for the duration of the flight; the New York Times said according to experts, the fact that the boy is alive is astonishing. “I just assumed that everybody who did this died,” Richard Marchi said, an airport consultant. He was said to have spent most of the night unconscious due to the lack of oxygen in the freezing wheel compartment. The boy, who had no identification on him, told officials that he had gotten into a dispute with his family and ran away from home which is in Santa Clara, California. “Officials have notified the boy’s family that he is safe,” the Office of Child Welfare Services said in a statement, according to the New York Times. Boeing, the maker of the plane, decided not to discuss the incident to avoid “…any information that might encourage such extremely dangerous and illegal activity,” a spokesman said. Though the boy did not remember how he got into the wheel of the plane, airport security cameras saw what seemed to be the boy climbing over the fence of the Mineta San Jose International Airport.

The New York Times found that since 1947, 105 people have stowed away in 94 planes worldwide according to the Federal Aviation Administration. The cold, low oxygen levels killed 80 of the 105 making the mortality rate 76 percent. The boy was among the minority who survived wheel-well stowaways.

New Season of The Boondocks starts tonight on adult swim

“The Boondocks” is a controversial animated series which deals with many issues surrounding the Black community in the United States. The series is based on a comic strip created by Aaron McGruder. The show can be considered racist by some people, for its harsh view on both black and white culture. The show centers around the Freeman family who have moved from inner city Chicago to the nice suburbs. Robert freeman (Grandadd), is an old school ex-civil rights activist who is in charge of his two grandchildren, huey and riley. Robert is often an irresponsible and gets caught up in all sorts of shenanigans. Huey and Riley are complete opposites. Riley is basically a product of all of the negative stereotypes in mainstream black culture. Huey on the other hand is an intelligent, well-read militant who looks up to revolutionary leaders like Malcom X and Che Guevarra; He also believes Ronald reagan was the devil.

I think the show uses Riley as a symbol of things wrong with the african american culture, and Huey as a symbol of progress, or someone who wants to make things better. The Show places the characters in all kinds of situations, sometimes based real events. The election of President Obama was the premise of one episode for example. The show even won a Peabody award for an episode in which Martin Luther King Jr. wakes up from a coma and is disappointed to see where black culture has gone.  The show may be a bit brash for some, but in my opinion it uses dark humor to expose many issues surrounding race. The new season premiers tonight on adult swim.

Sony May Not Make A Playstation 5!

Sony’s Playstation 4 has been a huge hit since its release back in November 2013. They have sold nearly seven million consoles worldwide and are still sold out in many places. Even with this big success Sony may not release a Playstation 5 in the future. Sony believes that the success later on down the road is going to be based on services rather than physical devices that play on optical discs or downloading them.

Shuhei Yoshida, the president of Sony WorldWide Studios has confirmed that Playstation is shifting to be service oriented and this could mean many things. They want to focus on delivering their products through the cloud and not require a separate device to play them. This means a TV can download an app that could allow you to stream any type of game.

Sony is about to launch Playstation Now, which will be the first attempt at streaming video games without having to use a disc or download them to your hard drive. They plan to use them on their own Playstation-branded devices and possibly on non-Playstation devices. If the service works it could be the next Netflix for video games. Sony will only make a Playstation 5 if there is a high demand for it.

I think this could be great, but the only issue I see is the cost to stream these games. Most people either own the old disc version and play them on the older systems and no one wants to pay twice for something they have. Also how fast of an Internet connection will it requires determines if it becomes a success.

Pokerstar sued by casino for almost $10 million over playing card scam

In Atlantic City’s Borgata hotel an interesting scam occurred, not from a lowly criminal criminal or mafia boss, but one of America’s biggest poker stars. Phil Ivey, a big name in the famous television-broadcast World Series of Poker, is being sued by the casino over an alleged marked card dispute.

Ivey used a printing error to his advantage – playing cards made by Gemaco, Inc allegedly were misprinted on the back on key strategy cards, giving Ivey an advantage as he would know which cards were being dealt to whom, then bet accordingly. The Borgata casino is also suing Gemaco Inc for their error.

How did this all go down? Since Ivey had a high roller status at Atlantic City casinos, the casinos allowed him enough freedom to pull off his scam. Borgata allowed him to provide his own sealed playing cards and approved his request to use an automatic card shuffler. This shuffler made it easier to spot the misprints, as a human shuffler would have mixed up the cards too much and made it difficult to spot the errors. Ivey was also permitted to bring a guest to his table.

Ivey pulled off this scam during multiple poker sessions in 2012, and his celebrity poker partner Cheng Yin Sun is also alleged to have participated in the scam.

Atleast 103 Dead; 199 People Still Missing in Sinking of South Korean Ferry

Wednesday, March 16, 2014, went down in history as one of the worst ferry accidents in South Korea’s ferry history. At least 103 people have died and 199 others remain missing. Many of them are students and teachers on a field trip from a high school near Seoul. South Korea’s Presidents says that the ferry sinking was a “murderous, unforgivable act” committed by the captain and crew members. . The captain initially told passengers to stay in their rooms and waited more than half an hour to issue an evacuation order as the ferry Sewol sank Wednesday. By then the ship had tilted so much that many of the roughly 240 people missing are believed to be trapped inside and 103 are left dead and the toll is likely to continue to rise, leaving more families in anguish.

The latest arrests of crew members bring the total number detained to seven as authorities investigate what went wrong on the ship. A radio transcript released by authorities suggested that passengers on the ship couldn’t reach lifeboats to escape because the ship tilted so quickly that it left many of them unable to move. The captain is defending his decision to delay the evacuation because it was a fast situation where no rescue ship was sent and no neighboring ships were near to assist him in the situation.

The captain was one of at least 174 people rescued soon after the Sewol began to sink, violating an “internationally recognized rule that a captain must stay on the vessel. The captain is facing charges including negligence and causing injuries leading to deaths. He is also charged with Mr. Lee is charged with causing the Sewol ship to sink by failing to slow down while sailing the narrow route and making a turn excessively.

Although 174 people were rescued soon after the vessel sank Wednesday, no survivors have been found since. After divers found a way into the submerged ship, search crews have been bringing ashore body after body. They are carried onto the dock one by one, tied up in identical white bags.Family members of the missing passengers wait anxiously, bracing themselves. The bodies are put on a stretcher, draped with a blanket and taken up a gravel path.
